SWIM TEAM INSURANCE WAIVER - 2010  WAIVER AND RELEASE OF ALL CLAIMS: I                                                                                (“Participant”) as a 2010 participant in the Genesee Swim Team at facilities owned by the Genesee Foundation (the “Team”) or as the parent/guardian of a minor child participant (“Minor Child”) do hereby recognize and acknowledge that there are certain risks of physical injury associated with the Team and I hereby agree to assume the full risk of any injuries, including death, damages or loss which I or the Minor Child sustain as a result of participation in any and all activities connected with or associated with such Team.  I also agree to waive and relinquish all claims I, or others on my behalf, may have as a result of my participation or the participation of the Minor Child in the Team, against the Genesee Foundation, its directors, officers, agents, servants, employees and members (collectively, “Released Parties”). I hereby fully release and discharge the Released Parties from any and all claims from injuries, including death, damage or loss that may accrue to me or the Minor Child on account of my participation or the participation of the Minor Child in the Team. I further agree to indemnify and hold harmless and defend the Released Parties from any and all claims resulting from injuries, including death, damages and losses sustained by the Minor Child or me and arising out of, connected with, or in any way associated with the activities of the Team.  I have read the above recreation waiver and release of all claims, and understand that my signature is required below in order to participate in the Team. Signature is required of all participants 18 years or older and of parent/guardian for those participants under 18 years of age. I do hereby represent and warrant that the Minor Child, if applicable, and I are in good health and have no physical limitation that would affect participation in the Team.   This Release and Waiver shall be governed by and construed in accordance with the laws of the State of Colorado and the exclusive jurisdiction for any disputes involving this Release and Waiver shall be the District Court for Jefferson County, Colorado or the Federal Court for the State of Colorado.  This Release and Waiver is binding to the fullest extent permitted by law.  If any portion of this Release and Waiver is found to be unenforceable, the remaining terms shall be enforceable.  The undersigned parent or legal guardian acknowledges that he/she is also signing this Release and Waiver on behalf of the minor and that the minor shall be bound by all the terms of this Release and Waiver.  This Release and Waiver shall be binding on Participant’s assignees, subrogors, heirs, next of kin, executors and personal representatives.  Participant's Signature - Note: a parent/guardian must sign for above listed participants if they are under the age of 18.               PARTICIPANT HAS CAREFULLY READ THIS AGREEMENT, UNDERSTANDS ITS CONTENTS AND SIGNS IT WITH FULL KNOWLEDGE THAT IT CONSTITUTES A WAIVER OF LEGAL RIGHTS.  Participant:                                                                                          Date:                                                                       Parent/Guardian if Under 18:
